Tell It To The Judge -- Dayne Popped for DUI

TMZ has learned '80s sensation Taylor Dayne was popped for DUI back on March 6. Poor thing even gets arrested in this town and no one notices.

Cops say the 46-year-old Dayne was arrested around 1:00 A.M. after she failed field sobriety tests.

The L.A. County D.A. has charged the singer with one count of misdemeanor DUI. Dayne's attorney, Scott Spindel, tells us she was originally stopped for speeding. He claims she blew below the legal limit -- .07 -- but is being charged for blowing above the legal limit. He says they "intend to vigorously fight this case."

She'll be back in court on June 2.

Lowe Lawyers Put the Law in Claws

The lawyers in the Rob Lowe nanny case are sharpening those legal knives -- and the fencing is pretty fierce.

Yesterday, TMZ told you first how Rob's lawyers filed a motion saying his nanny Jessica Gibson's complaint was full of bull. Well, Gloria Allred, Jessica's mega-lawyer, shot back, and we quote: "Rob Lowe's lawyers must not be aware of a U.S. Supreme Court case, Robinson versus Shell Oil, which held that former employees are protected from retaliation. They need to do their homework."

En garde! Lowe's own legal heavyweight, Larry Stein, had this to say, and again we quote: "I don't intend on arguing legal positions in the media, but rather in the courts where it should be done. But Gloria Allred is simply wrong on the law. I teach law at USC Law School. Whereas I teach law, she holds press conferences."

Gladiator Can't Drag Ex Into the Ring

Looks like that cage match between "American Gladiator" brutalizer Erin Toughill and her estranged husband just isn't gonna happen. Damn!

TMZ was in an O.C. court this morning when Toughill, or "Steel" as she's known on the show, faced off with Clark Bevans over a restraining order he filed against her. The couple agreed to stay away from each other -- as well as their respective training facilities. Erin told us outside of court she's glad "everything is resolved." That sound you heard was Bevans exhaling.

First sign of a problem marriage? Maybe when they allegedly tussled -- like pummeling each other tussling -- during their honeymoon, as TMZ told you first.

Frenchie to Shauna: Hit Me Baby One More Time!

Shauna Sand's estranged husband Romain Chavent didn't show for a court hearing this morning to discuss his bid for a temporary restraining order against the former Playmate. He should have, but because he didn't, his case was dismissed.
Shauna Sand and Romain Chavent
In the handwritten request for the TRO, Chavent says Shauna abused him on several occasions and told him she was going to "ruin [his] life." He also claims she "tried to take out my ring [sic] out of my finger" on one occasion, began to "shake me and grab my arm violently" in another confrontation and then "hit me" and "scratched my back," in another instance.

We're not sure why Chavent was MIA today. He filed for divorce from Shauna last month, citing irreconcilable differences. Or maybe he was pissed that her lucite heel collection had taken over his closet.

"Mermaid" Star Says Disney Threw Him Overboard

A guy who fell through a trap door on the stage of Broadway's "The Little Mermaid" says Disney is trying to make him look less banged-up than he really is.
Adrian Bailey
In a petition filed in New York, Adrian Bailey says the Mouse House told the press that he'd only suffered two broken wrists after falling 20 feet from a fake sailing ship onstage last Saturday. Bailey says that it was actually 30 to 40 feet, and that his injures -- ready to wince? -- include "a broken back, shattered pelvis, fractured sternum, multiple fractured ribs and a fractured foot, in addition to fractured wrists."

Dog to Hunt Without "Brother" Tim

TMZ has learned that Dog Chapman's felon-chasing litter is all back for "Dog the Bounty Hunter's" triumphant return to A&E -- well, all except for Tim Chapman, Duane's not-brother bro (they're not related) who was arrested last January in a Honolulu mall parking lot.
Dog Chapman
Check out the photo taken at the relaunch press conference -- Tim Chapman, Dog's partner in crime fighting for many years, is noticeably absent. A&E tells us he's taking a breather this season to deal with "personal issues."

City Attorney Says Worm is One Bad Apple

The L.A. County city attorney has charged bad boy baller Dennis Rodman with domestic violence after he allegedly hit his gf last month at a Los Angeles hotel.

Prosecutors nailed Rodman with several misdemeanor counts of spousal battery, brandishing a deadly weapon and one count of dissuading a witness.

Cops say Gina Peterson called hotel security on the evening of April 30 after she claims The Worm grabbed her arm after they had some sort of fight, causing a bruise. After the incident Rodman's rep told us that he had "had too much to drink" that night.

Dennis is currently at a rehab facility in Florida where two days ago he told us "I've never hit anyone."

DMX: Plea of My Plea is Not Guilty

DMX arrived one hour late to the Maricopa County Superior Court today -- a bad start to the first of many court appearances he'll be making in the future.

DMX pleaded not guilty on three felony drug charges, including two counts of marijuana possession and one for drug paraphernalia -- stemming from last week's raid of his Arizona home by authorities investigating alleged animal cruelty.

He still faces one count of misdemeanor animal cruelty -- along with that other pesky arrest from earlier this month.

Nick's Tears -- Crock of Fakery?

TMZ has obtained the extensive trove of letters and testimonials filed by the Hogan family to try to get Nick a soft sentence.
Nick Hogan
In his appeal, Nick's dad -- Hulk Hogan -- claims reality show "Hogan Knows Best" is "scripted" and that Nick isn't the wild kid people see on TV. He barely addresses Nick's insane driving and insists the whole thing was an "accident."

Nick writes that the ordeal since August 26 has been difficult and that he's a changed man -- but he still doesn't know how to spell. ("Diffiucult" and "chanegd," for the record.)

Also Included were letters from victim John Graziano to the Hogans -- written before the accident -- while he was serving in Iraq.

Lowes to Nanny -- Your Case is Full of S**t!

TMZ has learned that Rob Lowe just threw ex-nanny Jessica Gibson's complaint back in her face -- and is telling her to shove it.
Click to read the documents!
Just yesterday, a notice of demurrer -- aka a motion to dismiss -- was filed by the Lowes in Santa Barbara Superior Court. The Lowes are directly attacking nine of Jessica's claims -- all related to her claims of unpaid wages and retaliation. The biggest point being that Gibson herself even admitted to receiving a check from the Lowes last month for "owed wages and overtime."

The Lowes attorney, Larry Stein, tells TMZ, "We clearly stated our position in the demurrer."

We have yet to hear back from Jessica's legal flamethrower, Gloria Allred.

Barkley: The Round Mound of Gambling Debt

The Wynn Las Vegas has filed suit against former NBA star Charles Barkley, claiming he owes the casino $400,000 in gambling markers. Heck, he spends that at the buffet alone!
Charles Barkley
And to make matters worse, the Wynn is getting the Clark County district attorney's bad check unit to investigate, which also looks into gambling debts. Clark County DA David Roger says if Barkley doesn't pay up, he could be charged with a felony!

According to court docs, the casino fronted the NBA star four different $100,000 markers -- two each on October 18 and 19.

UPDATE: While playing in a golf tourney in Alabama, Barkley told the AP "My mistake. I'm not broke, and I'm going to take care of it."

Anne Heche Crazy Broke

Anne Heche got a break from the judge in her custody war today after appearing in court, claiming she doesn't have a pot to pee in ... even less than her deader-beat ex-husband.

An L.A. County Superior Court judge has suspended Heche's obligation to pay child support for July. Heche has been forking over $14,798 in monthly support.

In her declaration, Heche noted that her TV show, "Men In Trees," had gotten the ax. She says since January, "I have been unemployed and had no income....except for one very short term contract for a movie role for which I received a total of $65,000."

Heche says she has a grand total of $34,840.93 in her accounts. She claims she can't continue paying for Homer's private school tuition, her Canadian mortgage, L.A. rent, auto and other expenses. She says she's $364,000 in the hole.

BTW, Anne was spotted at the Malibu Beach Inn over the weekend. She blew $30 on appetizers, not including tip.
